Terms of Service
These Terms of Service govern your access to and use of Jenga360.
If you use Jenga360 on behalf of a construction company or other organization, you confirm that you have authority to accept these terms on that organization's behalf.
By creating an account, starting a pilot, subscribing to a plan, or using Jenga360, you agree to these terms.
The service
Jenga360 is a web-based digital construction management platform designed for construction companies and contractors in Tanzania.
Jenga360 provides tools that may help you manage areas of your construction business including tenders, tender documents, projects, financial records, people, documents, and other business information, depending on the plan and features available to you.
The features available to you depend on your subscription plan and the current version of the service.
We may improve, modify, add or remove features from time to time. Where a change materially affects the way you use the service, we will make reasonable efforts to communicate the change.
Jenga360 is a business management and information tool. It does not replace your professional, legal, financial, engineering, quantity surveying, procurement, or other professional judgment.
Pilot
Jenga360 currently offers a 30-day free pilot to eligible companies.
The pilot begins on the date your Jenga360 account or company workspace is activated and continues for 30 consecutive days.
During the pilot, you may use the features made available for the pilot programme, subject to any applicable usage limits or conditions communicated when you join.
At the end of the 30-day pilot:
- you may choose an available paid plan and continue using Jenga360; or
- your access may be suspended or closed if you do not select a paid plan.
We may extend, modify or withdraw a pilot offer for particular companies or circumstances at our discretion.
We may also limit or withdraw a pilot where we reasonably believe it is being misused, duplicated, or used contrary to these Terms.
Unless otherwise agreed in writing, pilot accounts are provided for evaluation purposes and do not include any service-level commitments beyond the support arrangements stated in these Terms.
Plans and payment
Jenga360 is provided through subscription plans displayed on the Jenga360 website or otherwise communicated to you.
Before starting a paid subscription, you will be informed of the applicable plan, price, billing period and payment requirements.
We currently accept payment through:
- electronic bank transfer;
- direct bank deposit;
- card payment; and
- mobile money payment.
Unless otherwise stated:
- subscription fees are payable in advance for the applicable billing period;
- fees are based on the plan you select and are not dependent on how frequently you use the service;
- you are responsible for providing accurate billing and payment information;
- applicable taxes, duties or government charges may be added where required by law; and
- subscription fees are non-refundable for a partially used billing period unless otherwise required by law or expressly agreed by Jenga360.
We may change our subscription prices in the future. If a price change affects an existing paid subscription, we will provide reasonable notice before the new price applies to that subscription.
Late or failed payments
If a payment fails or becomes overdue, we may notify you and give you a reasonable opportunity to correct the payment.
If an overdue amount remains unpaid, we may restrict or suspend access to paid features until the account is brought up to date.
We will not intentionally delete your company data merely because a payment is overdue without first providing reasonable notice and an opportunity to resolve the issue, subject to our data-retention and account-closure policies.
Your account
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
If you create accounts for employees, consultants, project staff or other members of your organization, you are responsible for ensuring that they use Jenga360 appropriately and in accordance with these Terms.
You should promptly notify us if you believe that an account has been accessed without authorization.
You are responsible for ensuring that information entered into Jenga360 is accurate and that you have the right to provide that information to us.
Your data
The business records and content that your company enters into its Jenga360 workspace remain your company's data.
Subject to these Terms and our Data & Security practices, we do not claim ownership of your company records merely because you store them in Jenga360.
We process information contained in your workspace for purposes necessary to provide, secure, maintain and improve the service, and for other purposes permitted by our applicable privacy and data-processing terms.
You remain responsible for ensuring that you have an appropriate lawful basis and authority to provide personal information about your employees, clients, suppliers, consultants and other individuals to Jenga360 where required.
Jenga360 will apply appropriate technical and organizational measures to protect information within the service, subject to the limitations described in our Data & Security documentation.

Data retention after account closure
When your subscription or account ends, your access to the service may be disabled.
Jenga360 may retain an archived copy of your company's workspace records for up to five (5) years after account closure.
This retention period is intended to support legitimate business purposes including historical record-keeping, contractual matters, accounting, audit, dispute resolution, service recovery and other lawful business requirements.
Personal data contained within archived records will be retained only where necessary and permitted under applicable data-protection requirements. Where personal data is no longer required for a lawful purpose, it may be securely deleted or anonymized even if the five-year business-record period has not expired.
Where applicable law requires a different retention period, the legally required period will apply.
You may request an available copy or export of your company's data before or within the applicable retention period, subject to reasonable verification, technical limitations and any applicable legal requirements.
After the applicable retention period expires, the relevant records may be securely deleted or anonymized.
Acceptable use
You may use Jenga360 only for lawful business purposes and in accordance with these Terms.
You must not:
- use Jenga360 to commit, facilitate or promote unlawful activity;
- attempt to access another customer's account or data;
- attempt to bypass security, authentication or access controls;
- interfere with the operation or security of the service;
- introduce malicious code, malware or other harmful material;
- copy, reverse engineer or attempt to extract the underlying source code of the service except where permitted by applicable law;
- use automated methods to abuse or overload the service;
- knowingly upload information that you do not have the right to use or disclose;
- use Jenga360 to infringe another person's intellectual property, privacy or other legal rights; or
- allow unauthorized people to use your organization's accounts.
We may investigate suspected misuse and may suspend access where reasonably necessary to protect the service, our customers, or other users.
Documents and AI-assisted features
Some Jenga360 features may assist you in reading, organizing, generating, summarizing or preparing business and tender-related documents.
These features are designed to assist your work. They do not replace your responsibility to review the information produced.
You remain responsible for:
- checking generated or extracted information;
- checking names, dates, amounts, deadlines, tender requirements and other important details;
- confirming that a document is appropriate for its intended purpose;
- making any necessary corrections;
- obtaining appropriate professional advice where required; and
- reviewing documents before signing, submitting or relying on them.
AI-assisted output may contain errors, omissions or interpretations that require correction.
You should never treat an AI-generated or AI-assisted output as automatically correct merely because it was produced by Jenga360.
Jenga360 does not submit tenders on your behalf unless a specific future service expressly states otherwise.
Jenga360 does not guarantee that you will win a tender, qualify for a procurement opportunity, receive an award, obtain payment, or achieve any particular project or business outcome.
Where Jenga360 prepares a document based on information you provide, you remain responsible for confirming that the final document accurately reflects your company's information and the applicable tender or contractual requirements.
Third-party information and services
Jenga360 may rely on or provide access to information, services, integrations or links supplied by third parties.
Third-party services may have their own terms, availability, limitations and privacy policies.
We are not responsible for the accuracy, availability or performance of third-party services that we do not control.
Where Jenga360 provides information relating to tenders, procurement opportunities, regulations, contracts or other external sources, you remain responsible for checking the original or authoritative source before relying on information where accuracy or timeliness is important.
Availability
We aim to keep Jenga360 reliable and available, but we do not promise that the service will be available without interruption.
The service may occasionally be unavailable because of:
- planned maintenance;
- emergency maintenance;
- infrastructure or hosting problems;
- internet or telecommunications failures;
- third-party service failures;
- security incidents;
- events outside our reasonable control; or
- other circumstances that cannot reasonably be prevented.
Where practical, we will provide advance notice of planned maintenance that is expected to materially affect access.
Support
Jenga360 provides customer support through the support channels designated by Jenga360 from time to time.
Our standard support hours are:
Monday to Friday, 8:00 AM to 5:00 PM Tanzania time, excluding public holidays.
We aim to provide an initial response according to the following targets:
Critical issues
An issue that prevents access to Jenga360 or makes a major business function substantially unusable.
Target initial response: within 4 business hours.
High-priority issues
An important feature is malfunctioning, but the customer can continue using Jenga360 through an alternative process or workaround.
Target initial response: within 1 business day.
Normal support requests
General questions, assistance requests, minor issues or feature-related questions.
Target initial response: within 2 business days.
These are initial response targets, not guaranteed resolution times.
Actual resolution times may depend on the nature and complexity of the issue, third-party services, infrastructure and other factors outside our reasonable control.
Where a critical issue is caused by a third-party service or infrastructure provider, we will make reasonable efforts to investigate and coordinate a resolution but cannot guarantee the third party's response or resolution time.
Ending the agreement
You may stop using Jenga360 at any time.
If you are subscribed to a paid plan, cancellation will take effect according to the billing and cancellation terms applicable to your plan.
Unless otherwise stated for your plan, cancellation should be made before the next billing period begins to avoid the next subscription charge.
We do not provide refunds for partially used subscription periods unless otherwise required by law or expressly agreed by Jenga360.
We may suspend or terminate an account if:
- you materially breach these Terms;
- you fail to pay amounts due after reasonable notice;
- your use creates a significant security or legal risk;
- you attempt to compromise the service or another customer's data; or
- we are required to do so by law or a lawful authority.
Where the circumstances permit, we will give you reasonable notice and an opportunity to correct a breach before terminating the service.
Termination does not remove obligations that by their nature should continue after termination, including obligations relating to confidentiality, intellectual property, outstanding payment, liability and dispute resolution.
Intellectual property
Jenga360 and its underlying software, design, interface, branding, documentation, systems, workflows and other materials are owned by or licensed to Jenga360 and are protected by applicable intellectual property laws.
Your subscription gives you a limited, non-exclusive, non-transferable right to use the service for your organization's internal business purposes during the applicable subscription period.
You retain ownership of the company data and content you provide to Jenga360, subject to the rights necessary for us to operate the service.
You must not copy, resell, redistribute or commercially exploit Jenga360 itself or its underlying software without our written permission.
Confidentiality
Each party may receive confidential information belonging to the other party while using or providing Jenga360.
Each party agrees to use reasonable care to protect confidential information and not disclose it except where:
- disclosure is necessary to provide or use the service;
- disclosure is required by law or a lawful authority;
- the information is already publicly available without breach of confidentiality; or
- the other party has provided permission.
Your company information, business records and non-public information provided through Jenga360 will be treated as confidential subject to the terms of our applicable data and security policies.
Liability
Jenga360 is provided as a business software service and, to the extent permitted by applicable law, we do not guarantee that the service will be completely uninterrupted, error-free or suitable for every particular business purpose.
To the extent permitted by applicable law, Jenga360 will not be responsible for indirect, incidental, special or consequential loss, including loss of profits, business opportunities, goodwill or anticipated savings arising from your use of or inability to use the service.
We are not responsible for losses arising from:
- inaccurate or incomplete information entered by you;
- your failure to review or verify documents or AI-assisted outputs;
- decisions made solely on information provided by Jenga360;
- your failure to maintain appropriate account security;
- third-party services or information outside our control; or
- events beyond our reasonable control.
To the extent permitted by applicable law, Jenga360's total liability arising out of or relating to the service will not exceed the subscription fees actually paid by you to Jenga360 during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.
Indemnity
To the extent permitted by applicable law, you agree to be responsible for claims, losses or reasonable costs arising from your unlawful use of Jenga360, your violation of these Terms, or your infringement of another person's rights through information or content you provide to the service.
This section does not require you to indemnify Jenga360 for losses caused by Jenga360's own unlawful conduct or matters that cannot lawfully be transferred to you.
Governing law
These Terms are governed by the laws applicable in the United Republic of Tanzania.
If a dispute arises between you and Jenga360, the parties should first attempt to resolve the matter in good faith through direct discussion.
If the dispute cannot be resolved through good-faith discussion, it may be referred to the courts or other dispute-resolution mechanism having appropriate jurisdiction in Tanzania.
Changes to these Terms
We may update these Terms from time to time.
When we make a material change, we will publish the updated version and, where appropriate, notify affected customers.
The updated Terms will apply from the effective date stated at the beginning of the revised Terms, subject to applicable law.
Your continued use of Jenga360 after the effective date constitutes acceptance of the updated Terms.
